Man Sues Convenience Store over Failed ‘Lucky Charm’

WASHINGTON, D.C. (Disassociated Press) June 18, 2007 - Sarkis Markoussian, a recent immigrant to the United States from Armenia living in the Washington, D.C. area, has filed a $67 million lawsuit for ‘discomfort, inconvenience and mental distress’ against a D.C. convenience store.

According to the suit, Markoussian went into Custom Convenience Corner, located in the Georgetown area of the District to purchase gum, malt liquor, a Power Bar and chewing tobacco, and was struck by the display of rabbit’s foot key chains near the counter.  Unfamiliar with the American lore of the luck of the rabbit’s foot, Markoussian questioned their purpose of store clerk Heck Grimes.

According to the suit, Grimes explained that carrying a rabbit’s foot was lucky, and “guaranteed that a rabbit’s foot would start bringing luck to Markoussian that day,” if Markoussian were to purchase one.

Markoussian, who had been invited to a get together at a TGI Fridays located near the Mall that evening, paid $3.95 for one rabbit’s foot key chain, thinking that the item would lead to a lucky encounter with a young lady he might meet at the event.

As it turned out, it was a get together of a group from the Washington, D.C. People for the Ethical Treatment of Animals (PETA) headquarters, and, much to his surprise, not a single young lady was impressed by Markoussian when he showed her his new acquisition.  After leaving the event, Markoussian went on to lose the key chain on his way home, along with all of his keys, which he had put on the chain.

The case is scheduled to be heard by District of Columbia Superior Court Judge Judith Bartnoff on August 14th of this year; ironically, it was only earlier this summer that Bartnoff heard a similar civil complaint involving a ‘guarantee’ and ‘same day service.'
